Please read these Terms and Conditions carefully before purchasing or using the Pathfinder career and college major assessment (the “Service”) offered by Flowers Consulting, LLC (“we,” “our,” or “us”), an Alabama limited liability company. By accessing the Service, completing a purchase, or submitting an assessment, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Pathfinder is an automated career and college major assessment product that delivers a personalized written report based on a student’s responses to a multi-part online questionnaire. The assessment incorporates three psychometric frameworks: Holland Code/RIASEC interest profiling, Enneagram personality typing, and Culture Alignment. Reports are generated with the assistance of AI technology and delivered electronically.

Pathfinder is intended for informational and educational purposes only. It is designed to help students explore potential career paths and college majors. It is not a substitute for professional academic advising, psychological counseling, or career counseling services.

2. Eligibility and Parental Consent

The Service is intended for use by or on behalf of high school students (approximately ages 14–18). If you are purchasing the Service for a minor, you represent and warrant that:

You are the parent or legal guardian of the student;
You have the legal authority to agree to these Terms on the student’s behalf; and
You consent to the collection and use of the student’s information as described in our Privacy Policy.

We do not knowingly provide the Service directly to children under the age of 13 without verifiable parental consent.

3. Purchases, Payment, and Delivery

a. Pricing

Prices for our assessment products are listed on our website and are subject to change without prior notice. All prices are in U.S. dollars.

b. Payment Processing

Payments are processed securely through Stripe. By completing a purchase, you agree to Stripe’s terms of service. We do not store your full payment card information on our servers.

c. Report Delivery

After purchase, you will be directed to complete the online assessment questionnaire. Upon submission, your personalized report will be generated and delivered electronically to the email address you provide. Delivery is typically completed within a short period following questionnaire submission, subject to system availability. We are not responsible for delays caused by incorrect email addresses or spam filters.

d. Refund Policy

Because Pathfinder delivers a personalized digital report, all sales are final once the assessment questionnaire has been submitted and the report has been generated. If you experience a technical issue that prevents delivery of your report, please contact us and we will work to resolve the issue promptly. Refund requests for other reasons will be considered on a case-by-case basis at our sole discretion.

4. Accuracy and Limitations of Results

Pathfinder reports are based on the responses you provide and are intended to offer helpful direction for exploration—not definitive conclusions. Results may vary depending on how thoughtfully the questionnaire is completed. We make no guarantees regarding the accuracy, completeness, or fitness of the report for any particular purpose, including college admission outcomes or career success.

The assessment frameworks used (Holland Code/RIASEC, Enneagram, and Culture Alignment) are widely referenced tools in vocational and organizational psychology, but no assessment instrument is perfectly predictive of individual outcomes. Students are encouraged to use their results as one input among many when making academic and career decisions.

5. Intellectual Property

All content on the Pathfinder website and within assessment reports — including text, graphics, logos, assessment questions, scoring methodology, and report frameworks — is the proprietary intellectual property of Flowers Consulting, LLC and is protected by applicable copyright and trade secret laws.

Your purchase grants you a limited, non-exclusive, non-transferable license to use your personal report for your own private, non-commercial purposes. You may not:

Reproduce, distribute, or publicly display report content without our written permission;
Resell or sublicense your report or any component of the Service;
Use our assessment questions, scoring logic, or report structure to create a competing product; or
Remove or alter any copyright or proprietary notices from our materials.

6. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Submit false, misleading, or fraudulent information on the assessment;
Attempt to reverse-engineer, scrape, or copy the assessment instrument or scoring methodology;
Interfere with or disrupt the Service or its underlying infrastructure; or
Use the Service in any way that violates applicable federal, state, or local law.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLOWERS CONSULTING, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DECISIONS MADE BASED ON YOUR ASSESSMENT RESULTS.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless Flowers Consulting, LLC and its members, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Alabama, and you consent to personal jurisdiction in those courts.

We encourage you to contact us directly before initiating any legal action. Many concerns can be resolved quickly through direct communication.

12. Modifications to the Service or Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We may also update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flowers Consulting, LLC regarding the Service and supersede any prior agreements or understandings.
